New Delhi, September 1.  Announcing the launch of a massive agitation with a protest rally by BJYM held at the CM’s residence on Sunday evening, the Delhi Bharatiya Janata Party today said an unprecedented constitutional and moral crisis is looming over the Capital of the country as even after a Delhi Court has issued an order to register an FIR against the Chief Minister in a corruption case, she is refusing to step down.


Addressing a joint press conference, Delhi BJP President Shri Vijay Goel and former Delhi BJP President Shri Vijender Gupta said, “This shameful subversion of all democratic norms in the form of continuation of Sheila Dikshit as Chief Minister is shocking. Her continuation in this post is a gross violation of all norms and traditions of governance.

“The Chief Minister must resign and if she is not ready to do so, Congress party must sack her. Her continuation is against basic norms of governance. She has been clearly indicted by the Lokayukta  for misuse of public funds and then the Court has put a stamp of approval on this by ordering registration of FIR.”

The two leaders said that a delegation of Delhi BJP will meet the President of India and the LG to press for sacking of the Chief Minister if she is not removed by her party within next 24 hours.

The two leaders also announced launching of an agitation for ouster of the CM. They also demanded a high level probe into Rs 300 crore spent on the ongoing advertising campaign which again involves similar misuse of public funds as it was done prior to 2008 polls.

They further added that that this case and the past cases against the CM and her cabinet colleagues have been indicted clearly show that there is a need to have much stronger Lokayukta in the city.  

“Had Lokayukta got sufficient powers, the Chief Minister and her corrupt cabinet colleagues wouldn’t have been  scot free. The BJP, after coming to power in Delhi, will ensure a stronger Lokayukta so that the high and the mighty should not be allowed to run away with public money. The Delhi BJP will formulate a new Lokayukta Act to ensure this ..”

In fact the Chief Minister has demeaned even the institution of Lokayukta as when she was indicted by him in this case she blatantly said that the Lokayukta had crossed his brief !  But the Court’s decision makes it clear that it was the Chief Minister who committed grave impropriety by misusing public funds.

The former Delhi BJP President Sh. Vijender Gupta had filed a complaint with Delhi Lokayukta for misuse of public funds by the Chief Minister in run-up to 2008 assembly elections. The Lokayukta had indicted her in this case and found her guilty of spending around Rs 22.6 crore of public money for her party’s political campaign. A Delhi Court has now ordered an FIR to be filed against the Chief Minister

The two leaders said in a joint statement, “Even after Lokayukta’s recommendation to the President in this case, the President and the LG did not take any action. Delhi Police also tried to give a clean chit to her by filing a closure report. It is clear that there were attempts to save her but the Court’s order have proved to be the last nail in the coffin of lies propagated by the Chief Minister.”

“In fact in the past there have been some other cases also in which the Lokayukta has clearly indicted the CM and her cabinet colleagues but it is unfortunate that neither the President of India nor the Lieutenant Governor is taking any action on this.”

In May 2013, the Lokayukta had recommended to President to issue an "advisory" to the Chief Minister and the PWD Minister asking them to desist from publication of their photographs on a form offering loan at low rates to entrepreneurs from SC, ST, OBC and minority communities. But no action was taken on this recommendation.

-The Chief Minister misrepresented facts about construction of 60,000 flats under ‘Rajiv Ratan Awas’ housing scheme back in the election year of 2008. Back then, her Government published several booklets and advertisements claiming that 60,000 flats were ready to be handed over for possession to the poor and slum dwellers.There were no flats which were ready. The Lokayukta had censured the Chief Minister for this but no action was taken on his report.

In Februray 2011, the Lokayukta of Delhi, in an unprecedented order recommended the removal of a senior minister in the Sheila Dikshit cabinet for trying to thwart a tax evasion probe against the owner of a well-known banquet hall.

Lokayukta Justice Manmohan Sarin indicted PWD minister Raj Kumar Chauhan for "grave misconduct by a public functionary" for trying to influence Jalaj Shrivastava, commissioner of trade and taxes, during a VAT probe against Tivoli Garden and Resorts in south Delhi for allegedly evading taxes and concealing income. Sarin also recommended Chauhan`s prosecution under sections of the Delhi Value Added Tax Act, 2004. Even in this case nothing happened.
